DAY 2: AITLAP AT THE DRAFT DATA PROTECTION BILL REVIEW

The Association was well represented today at the review meeting for the Draft Data Protection Bill, to consider the final version of the Bill. As a key stakeholder, AITLAP made significant contributions and strong advocacy on critical areas: Our Key Contributions: 1. Child Protection: We advocated for stronger safeguards and specific provisions to protect children's data in the digital space. 2. Data Subject Protection: We emphasized enhanced rights and protections for data subjects against misuse and exploitation of personal data. 3. Advocacy for Inclusion of Data Ethics & Algorithmic Discrimination: This was our major push. We advocated for the Bill to explicitly include Data Ethics and the prohibition of Algorithmic Discrimination. We argued that the law must prevent bias and unfair treatment of data subjects arising from automated decision-making systems. We cited practical examples where biased algorithms can cause harm, such as in: - Automated recruitment systems - Credit scoring and financial services - Mobility and transportation systems - And other AI-driven systems Our position is that Ghana's data protection framework must be forward-looking - protecting citizens not just from data breaches, but from unfair and discriminatory decisions made by algorithms. The Association remains committed to ensuring that the final Bill reflects global best practices and truly protects the rights of all Ghanaians in the digital age.
